Everyone I know just get on with a soul venue and let's face it, most of them are pretty dire by the end of the night floor wise irrespective of talc and as said previously, the loo's are terrible for flooding at major venues but no-one complains as it's not important. Maybe she had bad advice and thought she could sue the club not Mark... Them injury lawyers for you are bad news.. you sign a contract with them they promise you the world but if you pull out you have to pay there fees for work they carried out... Not a lot of work but high fees.. To be honest if I slipped in an overflowing toilet at a do and broke my arm i'd sue the venue... its the same as at work if it rains we have to put them yellow slippery signs out in reception saying wet floor.. It is our responsability.... its all health and safety... I would not sue a promoter for talc on the floor though.. Karen Have got to agree with Karen, talc can be a real pain, i know when we were running melodies in York last year had a stand up row with owner over people using talc, put notices up but everyone ignored them even offered to clean floor myself!! am sure if anything had happened he d have been on my case i did nt know about any insurance ,never crossed my mind. seems sad that everybody out to sue nowadays especially as its a friend. hope it turns out ok for you mate can really make you give up running soul nights when you hear of things like this. Mandy Posted August 1, 2006 Share Posted August 1, 2006 A girl I know tripped down a step at a Stafford Revival night a couple of years ago and went down the road of suing them due to personal injury. The club (what was the Top of The World) tried to bring the room hirer into it but failed miserably as a club it was up to them to keep an eye on health & safety issues not the people of hired the room. Good luck to them.. If you was in Tescos and slipped on a bottle of spilt talc and was unable to work due to a brokem limb and you was being paid SSP and because of that got behind on your loan payments on your car your mortgage etc, what would you do? Guest ruffsounds Posted August 1, 2006 Share Posted August 1, 2006 hi Mark Having read this thread i thought this is one for the wife who works for a firm who specialise in all forms of accident claims from all areas even Criminal ones and Workplace related accidents or Medical Negligence and she assures me that it is the Club's responsibilty and that they should shoulder the burden because if they are operating without a Public Liability licence the doors of the Club should not be open to the Public as it should have said licence under the Licencing Law of selling Alchohol and they are the ones who the responsabilty lies with. The talc would have been known about, As i presume they have had doos there before. Obvioulsly the club you hired did not show you or ask you to sign for anything like this. I have run soul nites here in stockport on numerous ocassions and never even given this a thought.... Occupiers Liability Act springs to mind having studied civil law as a module in my degree a few years back. Guest Little Miss Soul Posted August 3, 2006 Share Posted August 3, 2006 hi guys ,,in a bit of a perilous situation here..sorry if posting in wrong room. . i did a northern nite last year for my 40th..and hired a local club for the doo.. about 15 mins from the end..a friend of ours slipped on some talc and consequently broke her elbow..causing her to be off for some time.. the person decided to sue the club,,who have in turned passed this on to me being the hirer of the room. what i need to know is if anyone can help is the following:- ive been asked who my insurer is and obviously at the time its not something i thought of. Does this make things worse for me ? is it worth asking the injured party to cancel the claim? (its one of those no win no fee things) what likely charges are they likely to charge for doing so? im hoping our friend will be able to drop their claim but i have to admit that im shitting it a little..the price of entertaining eh? naturally this is a warning to all of you out there who put an event on and the consequent of an unfortunate accident.... thanks for any advice guys,,regards mark This sounds like a nightmare Mark. Sorry I can't give you any advice but I wish you lots of luck trying to sort this out. You would think the person involved would take personal responsibility for this wouldn't you?! Even if she's not involved in the scene, she could obviously see the talc on the floor! These people really annoy me.
