OK everyone, not sure if this is the right section but I have to tell you the following as the sh*t will soon start to hit the fan.

About 10 days ago I offered for sale a copy of Monique - If You Love Me (Show Me) - Maurci. I graded it vg+, said it was crackly at the start but overall played really well and loud - which it did. I very rarely overgrade records, especially when they are expensive/rare like this one.

So I had an email from a prospective buyer asking if I could send an mp3 of the record. I recorded the actual record and sent the full mp3 to the interested party. This party being Paloma Garcia from Spain. Yes, fine, she wants to buy the record, and pays me same day. I send the record, it's a done deal.

Until yesterday when she says that the record I sent her was not the one I recorded to mp3 - like I've got multiple copies of the Monique record lying around I WISH - and it crackled throughout. Well yes it did but it was barely audible under the very loud reproduction and of course she had already listened to the actual record and decided it was fine.

So she asks for her money back and I say no. I graded it accurately, she heard the whole record, just why should I refund the money because someone changes their mind or thinks can't make a profit on it?

So now, and I quote, she is going to cause me "damages" which will no doubt include a posting on here as to how I am a villain, a rip off merchant and a horder of Monique records.

So I'm explaining this now so you all know whats really going on. Yes I have disagreements with people on SS over topics. But I've never ripped off or deceived anyone with my record selling business, I'm not like that, I undergrade records and I will always sort something out in the unlikely event that there is a problem with a record. But when there isn't, and the person has already checked the record, why the hell should I refund the money?

No, we should not make light of these situations, its Petes integrity at stake here

and although plenty of people know the score when dealing with him and have no issues and put his service level and items purchased at near excellent

There are those who do not know Pete, and its that thought thats pissing him off, that he may be thought of as a shady dealer, which is not nice when its your livleyhood

First of all, I dont understand why if forum moderating closed the dispute, why Pete Smith continues blah blah blah blah with the same story in a new message... so that I have to reply again.

I dont want to continue with this argue. The only I have to repeat is that the mp3 have been recorded with a very very heavy needle on the turntable, a lot of weight improves condition that does not reflect the real condition of the record.

Some people says here is this forum that in other occasions Pete Smith offered returned the money. Why did you not do this time? Easy, I repeat again, because he knew that condition was far to the one he stated and it would be hard to resell the record with a bad condition.

I sell records since more than 20 years ago and I dont act like he did.

The difference between Pete Smith and me is that I go to sleep with my clear consciencie.

He told me that I had to sue him about that and I did. I dont have to add anything more.

You've read all the replies and it's pretty obvious who people believe. I never, ever overgrade records, what would the point of that be?

hi pete, sounds like someone wants a mint record, for vg plus price , stick to your guns , i do not buy records now, but bourght o lot of english stuff of you when you lived down south , eastbourne, i think, your prices were allways under every one else , also you grading ,is under graded all the time , you are like, as been said ,asda of record buying , yours mr j.p.

Pete, i only bought you a record once, and i didnt have problems at all, but what i dont understand is why didnt you return her the money if you offered that option to anothers before..? its just to know.. you could have sold the record to another person.. its not that difficult.. well, its what i think..

ok.. didnt want to say anything about it.. cause i think its a problem between Paloma and Pete, and they are who know very well about what happened..

Pete, i only bought you a record once, and i didnt have problems at all, but what i dont understand is why didnt you return her the money if you offered that option to anothers before..? its just to know.. you could have sold the record to another person.. its not that difficult.. well, its what i think..

Because it's hard work selling records nowadays and when it's an expensive one I want the person to be positive before the deal is done, which is why she was sent the mp3 of it, she was able to decide from that recording. To insinuate that I somehow doctored the recording, like she is doing, is slanderous - the usb deck plugs into the computer and I just record it using audacity, no filters, no clean up programs, nothing. The reason I didn't offer her the money back is because there is nothing wrong with the record, I would say the same to you if you bought something off me, if it's damaged or not as described, then yes I will take it back, but if it is exactly as described - then why should I take it back?

And another thing thats actually being missed here. £400 for that record is actually a bargain, even if it was in VG minus it would be worth more than that, someone who really wanted the record would have been absolutely delighted getting it for that price.

if you are getting bad mouth in spain now, maybe you should just stop selling them records..

So you don't need it you can't have people taking libertys.

Can I ask how long between recieving the record and Paloma (sorry not sure of name) getting in touch with you about it was?

We did talk about in private until she threatened me with slagging my name off on any and every forum and mailing list she could find, which is why this topic is called 'getting my retaliation in first' - she told me she was going to spread whatever rubbish she could make up.

Anyway, I've been asked to close the thread now so I will do so, if anyone wants to open a new one, fine by me.

Thank you to everyone who has supported me and offered testimony to my honesty, I think we all know the truth :thumbsup:
