I was mailed to say it was not available at this price. A mistake was made by a trainee and should be at auction.

I was advised that it would be ready to bid on in a few days.

Can they do this?

Current bid £106 with 2 days left....Richard Caiton - I See Love In Your Eyes (Caiburt 3041) sited book price £250.00 .As on Pat's site it at £100.00 current with 11 days left.

Could work out well for you as bidding looks low - check it out. Never the less still a great record to collect or purchase.

Still i do think when you this kinda thing happens it's a common courtesy to get in touch with you and offer a personal apology ,after all it's PAT's good name on the line and not some nameless trainee

It's good to know that Pat Brady is able to employ new staff though in this day and age!

I had a similiar experience with Pat Brady some years ago. He listed a copy of Flowers "For real" at £150. I reserved it and sent a list of trades saying I would pay cash if he did not need them. He got back to me saying he sold it to someone else...well well got myself a copy of Flowers a few years later but price was more than twice that sum.

Unfortuntately not. If money hasn't changed hands or you've received an e.mail agreeing to sell at that price there's no contract so he's not legally obliged to sell at the advertised price. Your only grounds would be if you could prove that the misprice was deliberate. The same situation applies when you buy in shops and although many retailers will honour their mistake, they don't have to.

I once came across a copy of Leroy Taylor - Oh Linda on Gemm for $10. The dealer refused my payment, again saying it was a mistake.

Steve's right. The price label is an invitation for you to make an offer to buy and until your offer is accepted by the seller no contract exists so he's quite entitled to refuse to sell . Legally it's called an invitation to treat.

I must say ive had no bad experiences with pat, but i think it was last year, i rang tim brown about a record as i thought god thats cheap, when he answered the phone at 10am he said harry your the hundredth person to ring about this, i`m sorry mate its sold, i said i`m not suprised at that price, to wich he replied yeh it was a typing error and then told me he had sold it to the first caller for the price on the list, as he really couldn`t do anything about it as that was the sale price on the list, wich as a buyer i think shows great customer service

maybe Tim isnt as knowledgable as Pat with the legal stuff regarding "set sale"

For my money (and in this case I'm glad it isn't) there is something about honour here. We all make mistakes, and as the owner of the business, if a member of staff makes a mistake and you don't spot it it is as good as yours, and its up to you to make it right. There may not be a legal obligation but I think there is definitely a moral one.

Personally I value my reputation far more than a few quid.

Some asked me why I sold to my collection to John Anderson rather than give other dealers a chance - well, all I can say is I don't think I have ever heard of John doing this kind of thing, or even anything similar. I'm told he would have made a fortune out of my records, well good luck to him, because he was always absolutely fair with me.

I did this yesterday - apparently the Big Shot 45 I listed yesterday is worth £80 more than I listed it for, couldn't go back once I'd agreed to sell it though.

I have since discovered that this was being auctioned on someones behalf (he pm'd me) so i do understand this is a genuine mistake.

I feel now that the owner of this record won't get such a good return knowing there are offers on this thread to sell this record and and my blurting out the price I paid!

Pat has now called me personally and I realize that it was a genuine mistake.

Pat was auctioning this for someone and therefore could not let it go at that price.

I am sure he's a reasonable and trustworthy man and would be happy to deal with him in the future.
