Bit of a stinker this.

I was the second highest bidder on an ebay lot and thought I'd missed out . The winning bidder was also a soul source member if an infrequent poster.

I then received a second chance offer on the item so asked the seller to confirm it was the same lot and why the high bidder had pulled out. The seller then replied confirming the lot was indeed the same and that he was not selling to the high bidder due to negative feedback (the sellers words not mine). I the sent him over $1,200 via paypal within minutes and he sent me a confirmation email to say the 45 were being shipped.

I have just received another e-mail from the seller telling me that the high bidder is going to complain to ebay and that he now feels he should sell them to the high bidder as long as he pays him this weekend.

I view the sale as complete. He made an offer, I did not solicit the offer, I paid him what he asked for straight away. To my mind he now should send the lot to me.

Either way the seller will be reported to ebay for non compliance I guess but I have done nothing wrong and have already paid for the lot and expect the records to be sent to me.

Am I being unreasonable?

As he has accepted your payment yes you should expect him to honour the sale.

As regards the highest bidder the seller could have rejected his bid at the time if he was concerned by his feedback. His problem not yours mate.

They're yours, he made you an offer, you've paid, by making the offer he had already rejected the winning bid.

You may had to go to a lot of trouble to transfer that money into your paypal account from your current account and you could even have incurred bank charges.

If the seller had restrictions he should have mentioned them in the copy on the item but that isn't your problem.

If you do end up missing out make sure that the seller refunds you and adds your paypal fees (which will mean that not selling to you will cost the seller an additional $90 or so - I wonder if he's thought about that)

Not sure he could have rejected his bid to be honest Derek it was a snipe with 6 seconds to go. Mind you mine was only 4 seconds earlier . I'm just not sure how ebay view these things but had the deal been face to face I would have walked away with the records when I paid for them so we wouldn't be in this mess.

Ebay would be fine if it is second chance as that is part of their criteria,sounds like you went by the book.

No your not, i had a similar situation about a year ago & insisted the seller honour the deal.

He / she made you the offer & you paid .......... contact the seller & tell them as you have paid you expect the deal to be completed to your satisfaction or you will take action against them.

The pickle they find themselves in is nothing to do with you.

Without knowing the full details why the high bidder was bypassed, its difficult to say - but if I were he, and I was not given a reasonable chance to pay, I would be extremely pissed off.

Really depends on how long after he offered you the records - a month later then fine.......3 days later and I would have asked if he thought he had given the high bidder reasonble time to complete the deal.

as has been said seller should have outlined his non acceptance of bidders with negative feedback.

original winner should have been allowed appropriate time to pay.

This is a common practice and not necessarily a scam. Caveat Emptor, however.

I've been offered records that I was the underbidder on. Sometimes the seller has multiple copies and offers the underbidder another copy of the record. Sometimes it's an unrelated third party who has a copy of the item and contacts the underbidder to offer the item they've missed out on.

It is also possible that it's a scam and obviously isn't covered by Ebay rules/protection.

Update:

The seller has finally agreed to send the lot to me after giving the high bidder until today to come up with payment.

The high bidder did at one point agree to drop out of the deal and not make a fuss if he was sent seven items he had chosen out of the lot (that I had paid for last Thursday don't forget) for FREE.

I in no way blame him for this mess but that was a bit of a cheek.

All I have to do now is cross my fingers that they actually arrive. I'm not counting my chickens of course.

Wow, thanks for posting that, I've just had the same thing with an Otis Lee. I thought it was strange cos I wasn't even the 2nd highest bidder and so it was a right bargain!

I just looked and no Ebay message so it's definitely a scam. I'm going to try and string em along - draw it out for ages , make them think I'm going to pay then tell them to f*** off

I was the person who won this item. Who basically was screwed out of my winnings that were rightfully fine. In fact I bid $1700 on this lot.... And had the money for it.........

It seems kinda funny that Ged emailed me after I won the items and wanted the Honey and the Bees 45 then all of a sudden the buyer would no longer sell to me.... I have not had any negatives for bidding.....

Anyway I told the seller in the end to send me a few of the 45's in the lot for my trouble with this crap... He took the Dynells and High Keyes also out of the deal but said I could by the other 4 for $400 or he would compensate me with $200 cash for all this mess.

I took the $200 for all this crap I had to go through just to try to purchase the records that I won fair and square....

You know it just amazes me that guys want to cry about not winning a auction but they don't won't to step it up when it comes to laying down some cash on it.....

Anyway I am squared away with the seller on this mess but Ged I hope you don't want any of my records in the future cause I won't sell to you after this.... Hope you like your "Honey and the Bees" and I hope that it was worth it to you to jerk someone out of their 45's.....

Might want to step up on your bids in the future.....

Simple fact is that if you are the winning bidder on Ebay then the said item(s) is yours as long a you pay the required total within the timescales quoted.

SECOND CHANCE OFFER is only legitate if it comes thru Ebay,END OF STORY.

As you can see from this I did not contact the seller until after the second chance offer had been made. You can see that by the fact that the auctionis live and that the item number has changed.

I did contact YOU to see if you wanted to SELL the Honey and the Bees what is wrong with that.

The seller chose to contact me to offer the second chance how the hell is that my fault.

I paid him what he asked for straight away agin not my fault.

It was you that asked him to seperate out items I had already paid for and be sent them free.

You clearly did not do anything wrong before that and I accept that. I did not do anything wrong at all but you seem to be suggesting that I made an offer to the seller after the auction had finished. Here for everyone to see is the evidence that I did not.

You may or may not choose to believe me or indeed sell items to me in future but my conscience is clear.

The seller jumped the gun in my opinion in making the second chance offer but that's not my fault. I paid for the lot on the Thursday and the seller was negotiating with Chris until Sunday before he agreed to ship the lot to me. All that time the seller had my money and it appears from what Chris has said was offering parts of the lot to him.

I will think long and hard before accepting any second chance offers in future no matter how much I wan a record.

Well it just seemed pretty messed up in my opinion. And the seller told me the same day I won the auction that It was not in good enough condition to sell. I guess what pissed me off is the fact that I never heard back from you after you asked me to sell the Honey and the Bees 45 and then I couldn't buy the records...

Anyway the whole thing seemed kinda shady but whatever... It's over with and I'm not sweating the couple 45's that were in there anyway...

But let me tell you the seller was not waiting on me for money... I had the money period.. He told me that day I had the weekend to get him the money and then immediately flip flopped and said they were not for sale...

As far as you having the right to buy them.. I guess you have that right if it's okay on your conscience......

I got a job lot of 300 or so off that seller last month. They were all there but the conditions of half of them left a lot to be desired.
