Hi Guys

It looks like I may have been taken by a member on here for £4000 for several records, and I might not be the only one. His name is Diego Padovese, from Rome. Does anyone know this guy (any of you guys in Italy), does anyone have a phone number for him. If he is a straight up guy he would have resolved his issue with Paypal with my transaction and the others out standing. See current 'Paypal Sucks' tread. If anyone does know him, but doesn't want to hand out his phone number then get him to phone me 07971 141858 (00 44 7971 141858). I'm about a few hours away from getting on a plane very angry.

Paypal sent me an email saying that this case with Diego Padovese was too problematic and they have reversed the $368 from my account back to Diego's. Diego says he wants to send back the record to me. I no longer own the record, he entered into a contract with Ebay and is now the owner. I'm assuming that anyone who sold records to Diego has had their money reversed back into his account. So guys we need to unite and get our money back. He has our money and our records!!! I always use the "EYE-TALIAN" postal service to send and receive rare records, expensive scooter parts, and the lot. It works. My mum has worked in there for 43 years, so I know what I'm talking about. I can't understand why you don't trust them, and trust other national postal services... Explain, please.

If I don't trust the postal service, I could use a courier company such as FedEx, TNT, Executive, DHL, etc... but I'd never had disappointment with Poste Italiane... Sometimes I've sent whole Lambrettas in UK with their courier service.

I'll be in Vicenza about midnight, tomorrow... Will you wait for a late night pint with me, mate...?

Bummer about money lads but why don't you [Dave and Joey] PM this Diego and just ask him to send your 45s to Roccia. He seems an OK kinda guy. At least you'd then know you'd not lost both 45s and money, and give you both some peace of mind. I know Joey you want the money but gotta make the best of a bad job.

If Roccia doesn't receive them then you know you've got a problem. No funds or whatever excuse, he's gotta have enough monery to send the 45s internally within Italy.

Im sure Roccia would be happy to send the 45s back if you cover his postage.

Rocca....I have to admit, all items I've had sent from Italy have arrived in good order. The problems start when things go wrong. I will never again buy anything from Germany....not that I have anything against Germans...but surely when an item that is sent fully insured, gets lost in the post, and 5 months later, I still don't have my £200 back...I can fully understand peoples reluctance to buy or have items returned from overseas.

We are on very low wage and every record we buy has to be saved for or another record sold to cover the cost, so although my loss may be counted as minor by some.....I will fight to the death for this money.

Diego has doing his best to solve the situation, and believe it or not, he's sincerely sad about this. He's a proud and honest guy, a true sportsman, a passionate collector, and a gentleman. He knows this story could put a shadow on him as a record buyer/seller/collector, and he's not very happy about it...

Maybe sometimes he's a bit naive, but definitely he isn't a thief, or worst...

I feel that I have to defend Diego, I don't know all the facts as I haven't spoken to any of the people involved in all this.However I must say that Diego is one of the most genuine,honest and kindest people I know.Yes he is a young guy and may have cocked up,but I can assure everyone on here that he is no crook.In fact he is one of the very few people I would trust with my life,wife and money.So come on give him the benefit of the doubt and give him a chance to put things in order (and yes he has been working in south america can you imagine how difficult this situation is for him ? )

I also don't have that much of a beef with Diego. He clearly got himself in a bit of a mess, but is trying to sort things out. My main beef is with Paypal and the shabby way they have delt with this. I just want my Paypal account back to normal. If I get the records back, which he said he would do, then I can start to sort things out my end. Shit happens, it's just how we deal with it that matters. Anyway I'm off to one of the best weekenders of the year tomorrow, LIFELINE. Worry about the rest next week.

But can you really blame paypal? I'm one of the ebayers on the front end of this, I sent Diego almost 200 dollars for a pair of Prog Records at the end of December. I never got them, he only once replied to one of my emails with a made up tracking number, and it looks like it happened to a score of buyers. I know that some of you say Diego is a good guy, but there are maybe 25 new Negative post on his ebay feeback, which is now private, so we don't really know the truth of this matter. Out of the lot of records he sold at the end of December, I don't think anyone got one! I'd love to hear from someone who did!

This is Diego's fault, and most likely his fraud.

Thanx for your post, some people who got burned by Paypal & or Diego have been a quick to give Diego a pass because he has sent them a email saying he would return the 45's. Diego emailed me and said he can Western Union the $402 (w/added ebay, paypal & shipping fees) When I finally recieve the money I will be the first to post it on this forum, until then...I'm leary as all hell. Diego & Paypal are at fault here. But so far Diego has our money and our records, just the sellers have been bung-holed!!! Diego make it right or we ain't going away!!!

Yep, Yep & Yep!!! If Paypal reversed the charges and gave them back to Diego, he surely has $402 to send me. Let's hope he agrees to the WESTERN UNION payment. They better not bootleg SAMMY ACUNA on Sly, (also released on New Wave) it's coming out on Ace/Kent in the near future. The thing that bugs me about Diego is that he only contacts me once a day through emails and each time he has a new way to make this deal right, I have to wait a whole day. OK guys pay attention, I think this is what's happening. My guess is Diego doesn't have the money.

I sent money to Diego, He was supposed to send me records. He never sends the records, or he never had the records (something about being shipped from Germany, no pictures, I should have known better, but he had a 600+ ebay rating so I went for it, and the shit was MINTY too!). He takes all the money he made, and buys the heavy records from you guys. A few weeks go by, and guys on my end don't get the records, so we start the claims process from Paypal. Paypal freezes his account so he can't sell or buy, but Paypal still has control over it, so in order to pay "us", the guys Diego originally conned, paypal starts revoking the secondary transactions that Diego made (buying 10,000 quid wort of records) with his "illegitimate" funds. It makes sense that Paypal would have just pulled it out of his bank account, after all why would they jeopardize the relationship they have with the legitimate sellers? It's with those customers that they make the cash with, so I think that sooner or later you sellers are going to get your money, I just hope they don't stick to that Unverified Buyer shit, that's low. Isn't that why our Paypal accounts are hitched to our checking accounts, and not a credit card? Just so they can do this type of thing?

So that's why I don't think there is any money in Diego's bank account. I'm not speaking for Paypal, but ebay politics on this side of the pond, makes me think this is how it's playing out. I'm not educated at all regarding international banking laws, so I'm just writing from the gut. I'm going to send a big email to paypal tomorrow, with all the details from this string, and my speculation to the truth of the matter, so maybe if we keep up the pressure you'll get paid, and I'll get my Gracious LP. Diago is on shakey ground but he could make it alot firmer if he did things through the right channels (like post on this thread instead of lurking and reading and email through ebay so they have a record). However, there is a bigger picture here that needs addressing, and closing a thread jsut because Jo Wallace has chatted to this guy and traded a couple of records with him will not help anyone, that includes Diego.

This thread should not be closed, there are more important things going on here than Diego's reputation that he could easily sort out by being more open and comunicating through ebay.

Just my opinion of course, but I think it's right.

Could you see the speaker of the house of commons during PM questions saying "sorry, we have to close prime minister's question time now because Tony Blair's reputation is being tarnished over the possibly illegal invasion of Iraq that he is refusing to answer questions about. Please leave the house quietly...."

Thanks for views, but looking at how this thread has evolved do think that at current moment it should stay open. He does seem aware of this thread, as its said he has been pm-ing members involved and as such if does have any concerns about this thread he can quite easily pm site or even post in the thread

James, it was the threats about contacting the clubs etc that concerned me...I also agree with you as to posting any progress but it needs to be balanced... I can understand peoples frustration and the fact that there are large sums of money involved. If Diego has overspent, then yes, he needs to sort it out quick before this boils over. But Paypal have been doing some very strange things recently and I don't think their administration of individuals accounts has made matters any easier in the dealings Joey and Dave have had with Diego. The re-transferring of funds is bizarre - and worrying.

Roccia has already explained, Diego has been in French Guyana in an enviroment where it's almost impossible for him to communicate with the rest of the world. I think it is excellent that we, ie. SS'ers, are made aware of any rip off merchants that you or anyone else on site comes in contact with. But, the point has been made by Joey and Dave and i was concerned that before things become too 'heated', both sides ie. dealers and Diego have the opportunity to sort matters out and then come back on Forum to give an explanation. That isn't being 'girlie' - it's being fair. If you'd traded records with me for the last 3 or 4 years and then something out of character happened, I would do the same thing for you and say that you'd always been a decent trader with me. Jo

Supposedly Diego has wired money though Western Union, I will go down there in one hour and find out if the entire $402 (cost of 45 and all the fees & postage associated with the transaction) is there. I will let you guys know straight away.

Another thing that puzzles me is he said he had the money in his paypal account before he got a chargeback a month later from paypal which he then used to buy the £10k worth of 45s what the f**k did he sell to get that much dough in his paypal account a ferrari ? you can only ask for 3 charge backs a year from paypal if you are a buyer. Is this a loophole to get a mate to put money in your paypal account you then spend the money then your mate makes a chargeback against you after you've spent all the dough. your mate then gets his money back and you've got 10k worth of 45's for f*** all. At the end of the day who spends 10k on 45s when they know they haven't got the money unless they are up to something.

For a while there, I thought that Diego just over spent, but I really wanna know if those guys that bought records from him but didn't recieve them and then got bogus tracking numbers from Diego, did they ever recieve them? When I heard this I thought for sure that I would never see any money!! I feel sorry for the person who sold him over $4000 worth of vinyl.

Diego sends me an email and asks why I had Ebay give him a non-payment strike!!!! Are you shitting me!!!??? Of course this was hours before he paid me through Western Union. I have contacted Ebay and told them that he finally took care of his mess. I'm still trying to sort it out with Paypal though. I still think Diego should get on this forum and share his thoughts, instead of lurking in the weeds.

I'm sorry, but as a burned bidder/payer I just find this comment so trite.

Whilst I aggree that threats etc are going too far, I'm glad that some people who have been refunded are still interested in the fortunes of others like us. It's heartening to think that they're not solely in it for getting thier money back and then getting out of town. I'm glad too that many who wisely avoided his auctions are still there to offer advice. So to all the concerned out there, please, don't "leave it at that", continue to be concerned!!! No one's pretending that this is the most pressing issue of global importance, but it's not idle chatter either.

I just want to remind people that Diego ran his fake auctions privately in a pre meditated (yet ultimately vain) attempt to minimize the fall out by silencing us. Since then he's done nothing but send us total bullshit. I'm in touch with four other, so far unrefunded bidders like myself. We're still waiting....and very much in the dark.. Some of us are having real problems getting refunded. So forums like this one are the only tool we have of guaging what's going on. You can't speak to anyone at pay pal beyond the call centre with their formatted replies, and Diego's blurred obfuscations, still referring to us all as his "mate", only confirm his limitless reserves of self pity and tenuous grasp of reality.

There's probably nothing more boring than listening to complaining consumers - which is basically what we are. I suggest then starting another thread called "Can't they put a cork in it?" As for me, after being ripped off to the tune of 607$ for items that I've been covetting for years - no I guess i can't yet put a cork in it. What a petty little person that must make me.

I'm totally with you on this one. I feel very lucky that I got my $402 back from diego. I honestly think that the people who bark the loudest and have the least to gain (my $402 your $607) might get their money back first. I truly feel sorry for the guys who got taken for THOUSANDS!!! The guys who are owed the most and speak up the least may end up yelling the loudest on this forum when they end up with zilch!!! I hope this doesn't happen, but knowing that Diego burned you guys on records he sold you, only makes me want to stick around till this thing comes to it's inevitable conclusion. I also love the reverse psychology angle, the more we pressure him, the more he might want to settle up just to spite his nay-sayers!!!

I have no problem with you or anyone else getting their money back, of course I don't, you've been stiched up and there has to be recomopense for that - I just don't like my quotes being taken out of context and used as an example of someone saying you shouldn't get your money back, he could have quoted half a dozen sentences on this thread saying it might be time to put it to bed as far as this forum goes but he chose mine so yes I do have a problem with that.
