I received in the post a copy of The Soul Notes Way-1006 that does not features "Don't make me beg" on B side... (I needed the 45 for this side)

So I wrote to the seller asking if it was a mistake and saying that I would send him back the record to either get the good 45 or a refund... Got no news at all.... Had to write him through paypal to get news...

He finally said that I could send back the record so I did... Then I've never got my money back - no news nothin'... The seller pretends that he never received it back...and now I can't claim anything from Paypal (too late...)

I make the mistake to cancel my Paypal claim before to receive the new ones...

I won a copy of Barry St John - Everything I Touch Turns to tears UK Columbia for £14.31 from Globalmusicauctions of Hampshire. Imagine my surprise when I received an email 3 days after paying for it saying they were very sorry but the record somehow got broken and they were having to refund my money. They also said there were fairies at the bottom of their garden which I could see if I wanted to.

Damien - if the ebay system will let you do it, raise a dispute anyway even if you're out of time. I raised one last year for non-delivery of not much, I think around a £10 record, from an ebay seller and raised through ebay then escalated to paypal. Paypal closed it as out of time. A week or so later I got a £20 credit in my ebay account and a nice mail from them saying my custom was valued so here's some money to spend on my next ebay purchase. It's worth a try if you can get through the system, try contacting ebay explaining your situation outside the dispute system if you can, you can phone them in the UK too if it was a lot of money. Paypal weren't interested but ebay were suprisingly responsive.

Ebay did this for me once, as well, and there wasn't even PayPal as part of the equation. A seller put up 10 copies of Ruth Brown's "Teardrops From My Eyes", Atlantic 919, for a BuyItNow price of $5.99. It's a 200 dollar record, easily (and the auction described them as "mint store stock"). I wrote the seller to make sure it was a 45, not the 78, which he confirmed. Still puzzled, I bought one - and somebody else took the other nine. Guy did not accept PayPal, but had good feedback, so I sent him a money order. He turned out to be a total lunatic - claimed that someone else had posted the auction in his name, that he'd never sell such a valuable record for so little, that he didn't receive any money from either me or the other party. It was so clear that this guy didn't realize what he had until after he listed it (he was doing multiple-copy listings of other, much less dear 45s at the time as well) that Ebay gave me a 25 dollar credit for my troubles.

No this is not boring, as this type of misleading is clearly done so you can be conned, the dealer will always say why did you not contact him/her before bidding its your fault, and when returning a recored always be clear to the dealer that you are going to send it regesterd and he must refund the postage to you once again he/she is planning that you arnt going to do this, as they are scum, my tip is allways deal with reputable dealers who you can trust see there feedback ect and if it looks a to good to be true record remember its 2009 not 2005 when you could pick up great records cheap. i would also recomend you by records especially rare ones not on line but of a list from poeple who have been dealers for a long time Ian Clark, Mick Smith ect you know what i mean? todays dealers online also seem to have a min bid that indicates that its a gen record and not a boot ect I hope you get your cash back and always check first if not with the dealer one of your mates as they may already know about a record SAM DEES Lonly for you Baby spring to ming as its a B side the DEMO is Double A DAVE KIL

Today I got a parcel delivered...in it a 10 UKP record. He is on deejaying very soon...maybe I`ll be there.

Everythings seems to be fine, just a mix up of parcels that can happen as we all know. Shall have my record in the next few days.

just slightly off topic, i got a mail from someone in sweeden who i sold a record to asking where it was. it was posted on 6th or 8 th feb, and he never payed for recorded delivery. i don't get proof of postage i just stick em in mail(sometimes thru work!!) so thought no more about it. has he left it too late to claim, and am i liable if he's left it 5 weeks before contacting me?OR is he just trying it on! couple of years ago i had 2 records go "missing" in the same town, i googled the addresses and they were 3 streets apart. coincidence or con? so therefore i am a bit wary to give refund out after such a long period. what do you think please?

i wont post anything abroad now, without it going signed for, i would have thought after two weeks he should have been asking, what postal service does he think we have that takes 5 weeks, if its a small value give him his money back and put it down to experience, only offer signed for abroad, look at e bay sellers refusing to send to certain countries now, i wont sell anything small value abroad as they usually only want your e mail address then have the bloody nerve to say it never got here, then my in box gets full with junk mail, and i only use it for e bay sales

Anyway, I've asked around to try find someone who's had a problem with an insured order, and then has actually collected on the insurance, and I've never found a case of it.

Totally agree with you in principle, however Paypal advise to send via a tracked method, buyers are responsible for shipping costs. An Ebay seller is allowed to incorperate insurance in these costs.

Sending items via an untraceable service always runs the risk of the buyer claiming item was never recieved. Paypal disputes will always find in favour of the buyer even if it is stated seller is not responsilble for items lost in the post. Certificate of posting is not proof of delivery as I'm sure many on here will already know.

Ebay is based on trust, but you will always get one bad apple in a barrel.

Very suprised that you took the risk of sending a $500 record to Italy, well documented that the Italian postal service is unreliable.

Might not be connected, but I had terrible mail problems from 2nd-14th Feb because of the snow here in the UK. Some stuff never arrived, some sat in depots and was delivered up to 2 weeks late. Caused me no end of problems both sending and receiving stuff and ended up costing me hundreds due to the consequential losses. The guy might be genuine, and your record's sitting in a sorting office in Swindon...

Always best to get proof of postage just to cover yourself, I've found the RM always cough up promptly if you make a claim, and it keeps those pesky customers happy.

Bought a Rose Battiste, thinking it was an original, but when it arrived I immediately saw it was the boot, so I sent this mail to the seller:

"Received the Rose Battiste 45 but it's a boot (and obviously I was after the original). Would you refund if I sent the record back?"

and here's his answer:

It is alright to sell a boot without mentioning it, if the seller honestly didn't know it. What's not alright is to refuse to refund any buyer's money anytime they ask, regardless of the reason - and your reason happens to be a really good one. If you bought it on Ebay I can't imagine that they won't see to it that you get refunded.

Well it was a lookalike boot, and it was scanned in the sleeve, so it was impossible to see if the label was glued on or moulded in the vinyl. Which has always been the easiest way to spot the boot on that one.

Still willing to send it back, but I want my cash back mate...

Not to sure if paypal dispute will hold up, item not claimed to be original, the record recieved was the one pictured and described in auction.

I know that in regards to counterfeit clothing paypal want written confirmation from either maker or authorised stockist.

Going to hard in regards to Revilot.

Kinda what I was thinking too. Still Ebay do have rules about selling boots and counterfeits so as long as they enforce it "Digger" should be alright. A thought!! Does that mean he might be better going through Ebay rather than Paypal?

Got a strange feeling about this one... Really don't want to go through the whole process of claiming the cash etc. That's why I was so disappointed when it turned out he didn't want to solve it the simple way.

Gotta say it's remarkable that the problems around records always emerge when buying from the bay, and never when buying from soul source.

Gonna keep trying to solve thru mail, and if I start the dispute I'll keep you guys updated so you'll know what'll happen when you get in the same situation.

There's something about 'distance selling' - if you change your mind you can send an item back within 7 or 14 days, not sure exactly.

Yes, I do know the seller you refer to. She is my wife and, more than that, is somebody who takes a great deal of pride in the way she conducts her buying and selling of records.

I was almost tempted to let this thread tail off and die a natural death but good judgement, fair play, and primal anger got the better of me!

Before I go on - here's a scan of the Paypal transaction that was processed on March 1st 2009. It may not be too obvious to somebody who doesn't enjoy the function of opposing thumbs but, to spell things out, it is the proof of the refund that was made to the buyer. As soon as you made her aware of the error, she contacted Ebay requesting a mutual cancellation of the auction.

You - the buyer - very 'helpfully' refused to do so. You instead went straight to Paypal for a refund although you had not returned the 45.

The upshot was that Paypal awarded in your favour with out her even noticing until now, as weeks, months can pass with out her checking the account. Had some one on here brought this thread to her attention, she'd still be none the wiser about it.

Check her reply to your feed back on Ebay.

Lets now move on to the actual 45. Despite having had your refund, she has not yet received the 45 that was in dispute. Any suggestions to where it might be? Perhaps some helpful Soul on here might offer to come kick your door down and find out??!!

If there is a lesson to be learned here, it's this. Never try to black someone's name when only half of the story is at hand. Also, never suggest taking someone's door off unless your are confident of your convictions (so, to the helpful person who suggested this, come say hello next time you see me).

I trust that this has enlightened those who may have been drawn in by this groundless bulls**t !!!
