Northern Soul Fist Logo

Just read this on Facebook, bag shop in Manchester trying to get the logo as there,s.

Anybody heard about this or is it bull ?

They are all at it nowadays, it comes of no surprise that the money grabbers are securing a trademark for themselves. 

An initial outlay for any trademark will make it yours.

Surely somebody must have tried to do that before? Been used by a lot of commercial operators, not least in recent years - Fred Perry, Ocean Colour Scene and so on. In fact I DJed in Cardiff last night for the Stone Foundation gig and the band have adopted it as their logo.

 

Would have thought that under those circumstances, anybody would find it difficult to trademark as their own? Then again, copyright, trademark law etc is notoriously intricate.

It's the Retro Bag shop in Manchester, they are asking the I.P.O to make the logo there trade mark, which in turn would mean nobody else can use it. Northern Soul Facebook page are trying to stop this, they have to prove the logo has been around for a few years.

Proof goes back to 1973 so far, but the I.P.O need people with proof of this to contact them.

I heard that someone, who shall remain nameless, 'copyrighted' the word Revilot and litigated against someone else, who shall remain nameless, who used it  :ohmy:

Don't think they copyrighted the name as such it did they?  They bought the rights to the label.  It's common knowledge isn't it as well?

They'll be on a hiding to nothing in my view. It's very easy to waste several thousand pounds with trademark and copyright specialist lawyers and even once you've done all that, it's still open to interpretation and the whim of the judge on the day. A good way to go bust.

I'd have thought even earlier. John Carlos raised his black gloved fist at the olympics in 1968. Various communist parties have used it since 1917 and apparently it was also found on Neolithic cave paintings. :lol:

 

Maybe they are copywriting a particular stylised version of the clenched fist?

I work in the same office building as the IPO.

I don't know if it will help, but if someone can give me info on who to contact, I can always arrange to pop over and have a chat.

 

I'm not bothered either way.  But while I am over there, i could pick up a few tips on how to copyright that old sew on badge with a guy on a Vespa, with the word Lambretta on it.

ive looked into copyright before re some of my designs.it can be a nightmare.Unless the persons concerned have radically changed the original design it could prove difficult as they did not create the image.They would also have to copyright each subject, ie T shirts, bags, badges etc and then each country,very expensive with no guarantee as Ian D already mentioned.Personally i think they've a bloody cheek, as for those who dont care , its the principle.The northern soul fist logo has been around a long time..its an icon of the culture and should be preserved as is.The origins are cloudy, and people will use that image.(I painted a huge circled black fist based on the ISC image on the drivers door of my first car back in 1973) but to try to copyright it is seriously over stepping the mark.I'm against the copyright.i suggest a boycott of their product as a warning.

I would have thought to obtain copyright/trademark the logo would have to be incorporated into some sort of design that identifies the manufacturer rather than the fist alone.  As Cliff says if successful I'd love to see them police it and begin to try and stop everyone who uses the fist in some sort of way.

Surely, the black fist image predates any use on the soul scene by a long time. It's use as a symbol of left-wing solidarity is well known. That takes it back to 1917, at least. So, what's all the fuss about? I can't see anyone succeeding in trying to copyright it, but, more importantly, I don't understand why anyone would want to.

I think Lambretta clothing copyrighted the name but were unable to stop scooter clubs using it on T-shirts etc, providing they had been using it for a certain time.

...in fact...I made a record box in 1976 whilst in a kids home. I painted it all red and put a silver fist on it. I also wrote Shoana 4 Me in me mad half hour of artistic flair. Unfortunately....I was late in the woods that night and I was 3rd in line...and walked back distraught. I'd run outta red paint....and it stayed on there with me silver fist until I sold the box at a boot sale in '81 with about 30 tunes i;d gathered in the 70's...! I luv'd her I did....for 1 night...10 minutes.....I did!x....................if only i;d have been a few minutes less doing me hair....i;'d have been first....she'd have agreed to marry me and I would have been the dad of many of me mates kids happy forever init!!!x Shoana....where r u now eh?!x I digress...I lay claim to using it since '76....but I ain't Spartacus....she'd have waited for me if I wos....I reckon.....!x

My first memories were of seeing Tommy Smith and John Carlos giving the raised fist salute in the the 1968 olympic medal ceremony, for days after the image was in newspapers and on the telly,however as someone else has stated the use of the symbol goes back further as a sign of solidarity and power.Cant see anyone getting the copyright on the sign,maybe with something else combined  but for the symbol itself...?

Is their website down after being crashed, hacked and generally stamped on? Brian Poulton of Scarborough cleary felt strongly enough to contest the matter officially. Christ, some people do get their knickers in a twist, do they not?

a lawyer recently copyrighted 'carry on and keep calm' with the logo of a crown and has been suing anyone who uses it if they dont buy a license. successfully i might add.

 

so, it s possible,

Ayup Sooty. Is this not the badge of the CUFC Away Supporters' Club? Apparently Oxford supporters wore a similar badge mentioning the word 'Shufflers'... On a more sensible note, do Stax have the copyright of the fist logo or finger-up symbol whatever you want to call it?

By being a 'tangible' design already, somebody must already own the rights to it. Who was the person or company that came up with it first and can they prove it (if needs be to stop the other shower).

Back in the 70,s my dad used to make them. Made of cast metal, with a leather bootlace to tie it round your neck. I used to take them to HMV in Bedford and HMV in Manchester. Took a few to WC at the time as well.Dad was trying to set up his own foundry business at the time. Wonder where they are now?

CUFC.  Carlisle United, founded in 1904.  Cambridge United, founded as Abbey United in 1912, renamed in 1951.  Colchester United founded in 1937.  Cumbriaaaans!
